If a staff member is convicted of violating a criminal drug statute at the workplace, he or she must inform a supervisor of such convictions (including pleas of guilty and nolo contendre) within five calendar days of the conviction. Failure to inform the supervisor subjects the staff member to corrective actions up to and including termination for the first offense.
As an alternative to termination, Duke reserves the right to offer staff convicted of violating criminal drug statutes participation in an approved substance abuse treatment program.
